1. GENERAL PROVISIONS

By placing an order on xmotorstore.biz, the Customer declares having read, understood, and accepted these general terms and conditions of sale.

2. HOW TO PLACE AN ORDER

Before submitting the order, the Customer can review the purchase summary, the products selected, prices, shipping costs, payment method, and the information entered.

3. ORDER CONFIRMATION

3.1 ORDER CANCELLATION
The Customer may request order cancellation by promptly contacting xmotorstore.biz.
If the order has not yet been processed, prepared, or handed over to the courier, xmotorstore.biz may cancel and issue a refund.
In the case of products specifically ordered at the Customer's request, customized products, products not normally available in stock, or items for which the product description indicates specific limitations, cancellation may not be possible once the procurement or production process has begun.
The mandatory rights recognized by applicable law remain unaffected.
3.1.1 MADE-TO-ORDER PRODUCTS
Some products on the site are procured exclusively at the Customer's request and may not normally be in stock.
For these products, delivery times may be longer than for items immediately available.
Once the procurement process has begun with the supplier or manufacturer, order cancellation may not be possible.
Where required by applicable law and clearly indicated in the product description, these items may be excluded from the right of withdrawal.
3.2 ORDER MODIFICATION
The Customer may request a change to their order within 24 hours of placing the order.
The change will only be possible if the order has not yet been processed, prepared, or shipped, and subject to availability of the requested products.
After this deadline, or if the order is already in advanced processing or shipped, xmotorstore.biz cannot guarantee acceptance of the change.
3.3 ORDER AND DELIVERY CONFIRMATION
Once the purchase is complete, the Customer will receive an automatic confirmation of receipt of the order.
The order may subsequently be confirmed, processed, and shipped by xmotorstore.biz.
Delivery times indicated on the website or in communications sent to the Customer are estimates only and may vary depending on product availability, courier services, destination, and circumstances beyond xmotorstore.biz's control.
3.3.1 PRODUCT AVAILABILITY
Product availability information on the site is indicative and subject to change without notice.
In the event of total or partial unavailability of one or more products after the order has been placed, xmotorstore.biz will promptly inform the Customer and, at the Customer's discretion, will refund any amounts paid for the unavailable products or replace them with equivalent products where possible.
3.4 PRODUCT INFORMATION AND DESCRIPTIONS
xmotorstore.biz is committed to maintaining the accuracy of the information published on the site. However, typographical, descriptive, photographic, or technical errors may occur.
Product images are for illustrative purposes only and may not accurately represent the product received, even though they retain their main characteristics.
In the event of an obvious error regarding the price, description, availability, or product features, xmotorstore.biz reserves the right to cancel the order, notifying the Customer and refunding any amounts paid.
Except as provided by applicable law, xmotorstore.biz cannot be held responsible for non-substantial differences between images, photographs, graphic representations, colors, packaging, or aesthetic details of the product compared to what the Customer received, provided that such differences do not affect the essential characteristics and functionality of the product.
xmotorstore.biz reserves the right to correct any errors, omissions, or inaccuracies on the website at any time, without prior notice.
4. DELIVERY
Products are delivered via a courier selected by xmotorstore.biz based on the destination, weight, volume, and type of products purchased.
Delivery times are approximate and begin from the time the goods are handed over to the courier.
Upon delivery, the Customer is required to verify the number of packages and the integrity of the packaging.
If the package is damaged, tampered with, opened, or has obvious anomalies, the Customer must accept delivery with a specific reservation written on the courier's delivery note, clearly indicating the problem encountered.
Any damage during transport, shortages, or anomalies must be reported to xmotorstore.biz as soon as possible, attaching photographs of the packaging and the product received.
Failure to specifically indicate reservations upon delivery may make it more difficult to process the complaint with the courier.
The rights of the consumer customer under applicable law remain unaffected.
In the event of non-delivery attributable to the Customer, incorrect or incomplete address, repeated absences, refusal of the goods, or failure to collect the goods from the collection point within the deadlines established by the courier, xmotorstore.biz reserves the right to withhold or charge shipping costs, any return costs, and any additional costs incurred for handling the claim.
xmotorstore.biz will not be liable for delays or inability to fulfill orders due to force majeure events, such as, but not limited to, strikes, logistics blockages, supplier unavailability, natural disasters, war, transportation service interruptions, computer failures, or events beyond its reasonable control.
5. SHIPPING COSTS
Shipping costs are calculated automatically during the purchase process, based on the destination, weight, volume of the products, and the available courier.
The customer can view the total shipping cost before placing the order.
Any free shipping promotions will be expressly indicated on the website, in the cart, or during the purchase process.
All consumer prices are inclusive of VAT, unless otherwise indicated.
6. ACCEPTED PAYMENTS
xmotorstore.biz accepts the payment methods indicated during the purchase process.
For example, the following may be available:
- payment via PayPal;
- payment by credit or debit card;
- payment by installments via PayPal Pay Later, where available;
- bank transfer;
- other methods indicated on the website.
The payment methods actually available are those displayed to the customer during checkout.
Any additional costs associated with specific payment methods will be indicated before the order is confirmed.
Card Payments and "1-Click" Option
During payment, the customer can choose to save their card for future purchases using the "1-Click" payment option, where available.

7. RIGHT OF WITHDRAWAL
Pursuant to Articles 52 et seq. of Legislative Decree 206/2005, the Consumer Code, the Consumer Customer has the right to withdraw from the purchase contract without providing any reason within 14 days of receiving the products.
"Consumer" means a natural person acting for purposes outside of his or her business, commercial, artisanal, or professional activity.
The right of withdrawal does not apply to Customers purchasing with a VAT number or for professional, commercial, entrepreneurial or business purposes.
7.1 EXERCISE OF THE RIGHT OF WITHDRAWAL
The consumer customer may exercise the right of withdrawal through the dedicated digital procedure made available by xmotorstore.biz on the website.
The customer must access the section dedicated to returns and the right of withdrawal, complete the electronic form provided, and follow the instructions provided by the system.
The withdrawal request must be submitted within 14 days of the product delivery date.
Once the request is submitted, xmotorstore.biz will confirm receipt of the communication via email or other electronic communication.
It is not necessary to send registered letters, paper communications, or additional confirmations, unless specifically requested otherwise by xmotorstore.biz for verification purposes.
7.2 PRODUCT RETURNS
After communicating the withdrawal, the customer must return the products within 14 days of the date on which they communicated their decision to withdraw.
Products must be returned intact, complete with accessories, manuals, documentation, and original packaging (if applicable), and adequately protected for shipping.
The Customer is advised not to apply labels or tape directly to the original product packaging.
Return costs are the responsibility of the Customer, unless otherwise expressly indicated by xmotorstore.biz.
Cash on delivery or returns paid by xmotorstore.biz will not be accepted unless prior written authorization is obtained.
The Customer must use suitable packaging to protect the product during transport.
The return address and instructions will be provided during the online withdrawal process.
7.3 REFUND
If the right of withdrawal is correctly exercised, xmotorstore.biz will refund the Customer the payments received for the products subject to withdrawal, including any standard delivery costs incurred at the time of purchase.
Any additional costs resulting from choosing a delivery method other than the standard delivery offered by xmotorstore.biz will not be refunded.
The refund will be made using the same payment method used by the Customer for the purchase, unless otherwise agreed between the parties.
xmotorstore.biz may withhold the refund until receipt of the products or until the Customer has provided proof of shipment, whichever is earlier.
The refund will be made within the timeframes established by applicable law.
7.4 DECREASE IN VALUE OF GOODS
The Customer is responsible for any decrease in the value of the products resulting from handling other than that necessary to establish their nature, characteristics, and functioning.
In the case of products that are used, assembled, damaged, incomplete, missing the original packaging where essential, altered, or returned in conditions unsuitable for resale as new, xmotorstore.biz may apply a proportionate reduction to the refund, commensurate with the actual decrease in value found.
The discount will not be applied automatically, but will be assessed on a case-by-case basis based on the actual condition of the returned product.
7.5 EXCLUSIONS FROM THE RIGHT OF WITHDRAWAL
Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded in the cases provided for by law, including, but not limited to:
- products made to measure or clearly personalized;
- products ordered or procured specifically at the Customer's request and not normally available in stock, if this exclusion is clearly indicated in the product description before purchase;
- products that are liable to deteriorate or expire rapidly;
- sealed products that are not suitable for return due to hygiene or health protection reasons and that have been opened after delivery;
- products which, after delivery, have been inseparably mixed with other goods;
- other cases provided for by Article 59 of Legislative Decree 206/2005.
If a product is excluded from the right of withdrawal, this circumstance will be indicated in the relevant product sheet or otherwise communicated to the Customer before completing the purchase.
7.6 PROMOTIONS, KITS, AND COMBINED PRODUCTS
In the case of purchases made as part of promotions, kits, bundles, combined offers, or products sold with free gifts, the return may apply to the entire set of products purchased, if the discount, promotional price, or free gift is linked to the combined purchase.
If the Customer returns only a portion of the products purchased under the promotion, xmotorstore.biz may recalculate the amount due, taking into account the regular price of the products retained by the Customer or the termination of the promotional conditions applied to the order.
7.7 SIZE EXCHANGE
For clothing or similar products, xmotorstore.biz may offer, at its discretion and according to the conditions indicated on the website, a size exchange service.
Size exchanges constitute a voluntary product replacement procedure separate from the exercise of the right of withdrawal.
The sending of a replacement product does not automatically trigger a new withdrawal period, which remains linked to the delivery of the original order, unless otherwise provided by mandatory law.
Size exchanges may be granted only once, unless otherwise decided by xmotorstore.biz.
In any case, the mandatory rights recognized to consumers by applicable law remain unaffected, including the legal guarantee of conformity in the event of a defective or non-compliant product.
7.8 DISPUTES AND ALTERNATIVE RESOLUTION
The consumer customer may resort to the alternative dispute resolution bodies provided for by applicable law.
xmotorstore.biz invites customers to contact customer service in advance to attempt an amicable resolution to any issues with their order.
8. WARRANTIES
Products sold by xmotorstore.biz are covered by the legal guarantee of conformity provided for by the Consumer Code, where applicable.
For consumer customers, the legal guarantee applies in accordance with the terms and conditions set forth in Articles 128 et seq. of Legislative Decree 206/2005.
For professional customers, those with VAT numbers, or those purchasing for purposes related to their professional, commercial, entrepreneurial, or artisanal activities, the guarantees set forth in the Civil Code apply.

The Customer is responsible for verifying the compatibility of the product with their vehicle before purchasing, including by comparing the original part numbers, measurements, technical specifications, and vehicle data.
xmotorstore.biz cannot be held responsible for purchases made based on incomplete or incorrect verifications by the Customer.
The Customer is also responsible for verifying any limitations on use, approval requirements, authorizations, or prohibitions applicable to the purchased product.
xmotorstore.biz assumes no responsibility for uses that do not comply with current regulations, for the use of products intended for sporting use on vehicles circulating on public roads, or for use of the product in violation of applicable laws.
Product installation must be performed by qualified personnel and in accordance with the manufacturer's instructions.
xmotorstore.biz cannot be held liable for damage resulting from incorrect assembly, improper use, use on incompatible vehicles, use in unauthorized environments, tampering, modifications, ordinary wear and tear, or failure to follow the manufacturer's instructions.
The warranty does not cover defects or damage resulting from normal wear and tear, improper use, negligence, improper installation, inadequate maintenance, use in competitions or extreme conditions, unless otherwise provided by mandatory law.
Any commercial warranties offered by manufacturers are in addition to the legal warranty, without limiting or replacing it.
9. APPLICABLE LAW AND JURISDICTION
These general conditions of sale are governed by Italian law.
For any dispute relating to the application, execution, interpretation or validity of these Terms and Conditions of Sale and of any contract concluded through xmotorstore.biz, the buyer accepts the exclusive jurisdiction of the Court of Turin.
For any translations into other languages, in the event of discrepancies or differences in interpretation, the Italian version shall prevail.
